Not yet a tax certificate. Smart Safari Kids is [not currently / ___] a registered Public Benefit Organisation. Unless we state otherwise in writing, donations are not tax-deductible and no SARS Section 18A certificate is issued. We issue a standard receipt for every contribution.
1. Who we accept contributions from
- We accept sponsorships and donations from identifiable individuals (18+), registered businesses, and registered organisations.
- We do not accept anonymous contributions, cash, cryptocurrency, or third-party payments where the true source cannot be verified.
- All payments must be made by traceable means (electronic funds transfer or card) through our payment processor or named bank account.
2. Identity & source-of-funds checks (KYC / FICA)
To comply with the spirit of South Africa's Financial Intelligence Centre Act (FICA) and to prevent money laundering, we may require, before accepting a contribution:
- Full legal name and contact details (individuals) or registered name and registration number (entities);
- Proof of identity or company registration;
- For larger contributions, a written declaration of the source of funds;
- Details of the natural person(s) ultimately controlling a contributing entity.
We may decline or delay any contribution pending these checks. We screen contributors against applicable sanctions and watchlists and will not knowingly accept funds connected to crime, sanctions, or terrorism financing.
3. Our right to refuse or return funds
We may, at our sole discretion and without obligation to give reasons, refuse, return, or refund any contribution — including where we cannot verify identity or source of funds, where a contribution may damage children or Smart Safari Kids's reputation, or where we suspect unlawful activity. Returned funds are sent back to the original verified source only.
4. Sponsor brand standards (child-safety)
Because our users are children aged 5–13, we will not associate with, and reserve the right to reject, any sponsor whose products, services, or brand involve: alcohol, tobacco or vaping, gambling or betting, adult content, weapons, payday/short-term lending, political campaigning, or anything we judge inappropriate for a children's learning platform. Sponsor logos and messaging must be approved by us in writing and may not target children with advertising or data collection.
5. Use of funds & transparency
- Sponsorship funds are applied to the specific competition prize pool and associated costs agreed in writing.
- Donations are applied to keeping the free tier available, supporting under-resourced learners, and running the platform.
- We keep records of contributions and their use, and can provide reasonable reporting to contributors on request.
- Contributions are not investments. They carry no equity, interest, return, or expectation of profit.
6. Refunds, chargebacks & errors
Genuine donations are generally non-refundable once applied, except where required by law or where funds are returned under clause 3. If you believe a payment was made in error or without authorisation, contact us immediately at hello@smartsafari.kids. Fraudulent chargebacks will be investigated and may be reported.
7. Data protection (POPIA)
Information collected for verification is processed under the Protection of Personal Information Act (POPIA), used only for compliance, receipts, and reporting, kept securely, and retained only as long as the law requires. See our Privacy Policy.
8. Record-keeping & reporting
We retain records of contributions, identities, and source-of-funds information as required by law, and will cooperate with lawful requests from regulators, the Financial Intelligence Centre, or law-enforcement, including reporting suspicious or unusual activity where the law requires.
9. No endorsement
Accepting a sponsorship or donation does not mean Smart Safari Kids endorses the contributor, and a contribution does not buy influence over curriculum, content, or which children are featured or rewarded.
10. Governing law
These terms are governed by the laws of the Republic of South Africa. Specific sponsorships are also governed by the separate written agreement signed for that sponsorship, which prevails if there is a conflict.
These terms are provided in good faith as a starting framework and are not legal advice. Before accepting contributions, have them reviewed by a South African attorney and accountant, and confirm whether FIC registration or PBO status applies to you.
