Smart Safari Kids — Terms of Use

Please read these Terms of Use ("Terms") carefully before using Smart Safari Kids (the "App"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.


1. What Smart Safari Kids is — and is not

Smart Safari Kids is an educational entertainment app. Its content is designed to be aligned with, and inspired by, the South African CAPS curriculum, and to support learning through play.

Smart Safari Kids is not a school, a registered educational institution, a tutoring service, or an accredited education provider. We do not issue qualifications, certificates, or accreditation. The App is a supplementary learning aid and a form of entertainment — it is not a substitute for formal schooling, a teacher, a tutor, or a parent's own involvement in their child's education.

We make no guarantee that use of the App will produce any particular educational outcome, result, grade, or improvement. Questions and content are provided "as is" and may contain errors; we welcome corrections via the contact email.

3. Accounts, subscriptions and payments

Some features require a free parent account; some require a paid premium subscription. Payments, where applicable, are processed by our third-party payment provider (Paystack). We do not store your card details. Subscription pricing, billing terms, and any refund or cancellation rights will be shown at the point of purchase and are subject to the payment provider's terms and applicable South African consumer law.


4. Acceptable use

You agree not to misuse the App, including by attempting to break, reverse-engineer, overload, or gain unauthorised access to it or to other users' data, or by using it for any unlawful purpose.


5. Intellectual property

The App, its content, design, and branding are owned by the operator or its licensors and are protected by law. You may use the App for your family's personal, non-commercial use. You may not copy, resell, or redistribute the App or its content without permission.


6. Limitation of liability

To the fullest extent permitted by law:

Important note on South African law: Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2008. Where the law gives you rights that these Terms cannot override, those rights still apply.


7. Children

The App is intended to be used by children under the supervision and with the consent of a parent or guardian. By allowing a child to use the App, the parent or guardian confirms they consent to that use and to the processing of the child's information as described in our Privacy Policy.


8. Changes and termination

We may update, suspend, or discontinue the App or any feature at any time. We may update these Terms from time to time; material changes will be communicated to account holders, and continued use after changes means you accept the updated Terms. We may suspend access for users who breach these Terms.


9. Governing law

These Terms are governed by the laws of the Republic of South Africa, and any disputes are subject to the jurisdiction of the South African courts.

Because Smart Safari Kids serves children and processes payments, we strongly recommend having these Terms reviewed by a qualified attorney before commercial launch to ensure they are valid and enforceable under South African law (including the Consumer Protection Act and POPIA).
